"I was just riding my bicycle," Elswick an Orange County Florida man told the court. Local News Click Orlando reported the man received two traffic tickets while riding his bike. The man claimed it was the first time he'd been on a bicycle in decades and did not know that the same laws apply to both bicycles and motor vehicles. Elswick was found guilty for failing to stop at a stop sign and forced to pay the $164 fine plus $33 for court costs

Red light camera programs are ending in cities all over the state. Last year Los Angeles and San Bernardino are among major cities which chose to stop using red light camera enforcement and recently ABC-10 News has reported El Cajon City Councilman Gary Kendrick said it's time to bring those cameras down. According to Kendrick, more than 10,500 red light camera tickets were issued in El Cajon in 2011, adding up to about $5 million in revenue. However, less than 10 percent of that money went back to the city, and the rest went to the company operating the cameras. Kendrick said he'd rather see people spending that money at local businesses than on ticket fines.

The law generally restricts solo drivers from using carpool lanes; however, there are limited and specific exceptions to the rule. The website of the California Highway Patrol provides the following guidelines to help you determine when it is OK:

  • Part-time HOV Lanes - Some lanes are restricted to carpools only during high-use commute hours. It is legal for single-occupant vehicles to use the HOV lanes if it is outside those HOV hours of operation. Signs will be posted along the HOV lane telling you when the lane is restricted to carpools only. These part-time HOV lanes are most common in northern California.
  • High-Occupancy Toll (HOT) Lanes- These freeway facilities are also called "Express Lanes" and allow single-occupant vehicles to use the HOT lane by paying a toll electronically (with a FasTrak transponder). Most HOT lanes allow carpools to use the lane for free (local signs will specify this and indicate if carpools must carry a FasTrak transponder). HOT lanes may not be used by vehicles restricted to a 55 MPH speed limit. An example of an HOT lane is the Sunol Grade on Interstate 680 in the San Francisco Bay Area.
  • Vehicles with White and Green Clean Air Decals - With these decals, drivers can drive solo in HOV lanes (unless locally prohibited)
  • Motorcycles - Solo motorcyclists can use HOV lanes (and most HOT lanes) without a decal unless otherwise posted. Motorcyclists cannot ride on, in, or over solid double lines.

According to CHP press release, “even though California’s seatbelt requirement went into law more than a quarter- of –a- century ago there are some drivers and passengers who still resist the few seconds it takes to safety buckle up, or they may not properly secure a child in a car seat.”

CHP received a federal grant to help fund a campaign aimed at raising seatbelt safety awareness and part of the campaign is also additional seatbelt enforcement out on the highways throughout the end of September.  Increased seatbelt enforcement means you are less likely to get a warning or a pass and more likely to get a ticket!

If you frequent busy cities like Los Angeles or San Francisco you may find yourself parking curbside a lot. With all the hustle and bustle you may accidently swing your door open when traffic is whizzing by. You may be surprised to hear that you can get a ticket for this.

The CA DMV defines V C Section 22517, “Opening and Closing Doors” as this:

“No person shall open the door of a vehicle on the side available to moving traffic unless it is reasonably safe to do so and can be done without interfering with the movement of such traffic, nor shall any person leave a door open upon the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.”

To avoid a ticket, you would need to wait until there is no traffic to open the door on the side of traffic. If there is no safe time to open the door on the side of traffic some sources say you should exit your vehicle from the curbside where it would be safe to open the passenger side door (if it is the driver's side that is on the traffic side). For many Californians it is almost impossible not to use a phone at some point while driving. Even more tempting is to use that phone while stopped a t a red light or while stopped during a traffic jam. Now while it may seem logical that while you are stopped in your vehicle, you are not driving, CA court rulings do say different. In the case of People v. Nelson, the court clarified that using a phone while driving is prohibited even while stopped at a red light.

While the penalties for a ticket for using  a cell phone while driving may not  seem as serious as a ticket for a red light which can be several hundred dollars, these cell phone use while driving tickets can be almost $200.00 after all the extra fees are added on. A driver facing a steady circular red signal alone shall stop at a marked limit line, but if none, before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection, and shall remain stopped until an indication to proceed is shown, except as provided in subdivision (b). Circumstances

Valued customer Omar brought his Commercial Driver Out of Lane ticket to TicketHitMan.com, looking for help as he is a commercial driver and without the ability to attend traffic school would have been affected by having the ticket go on his record. 

Solution

The TicketHitMan.com Team researched Omar’s violation and prepared a Trial by Written Declaration for him to use in defending his ticket. The Trial by Written Declaration cited the law of California Vehicle Code Section 22348 (c) allowing commercial drivers to drive out of the required lane:

“When overtaking and passing another vehicle proceeding in the same direction, the driver shall use either the designated lane, the lane to the immediate left of the right-hand lane, or the right-hand lane for traffic as permitted under this code. If, however, specific lane or lanes have not been designated on a divided highway having four or more clearly marked lanes for traffic in one direction, a vehicle may also be driven in the lane to the immediate left of the right-hand lane, unless otherwise prohibited under this code.”

Here Omar had felt he was permitted to drive out of the right lane in order to overtake or pass another vehicle. In this case, the truck in Omar’s intended lane was traveling at about 25mph, and it was certainly not necessary for him to travel at that speed, especially considering his trailer was completely empty and the speed limit for his vehicle was 55mph. The trucks in the lane were impeding traffic in violation of California Vehicle Code section 22400 and it became necessary for Omar to pass. Since Omar was passing slower moving vehicles traveling in the same direction, Omar’s defense outlined why his actions were permitted under the law. 

Conclusion

States such as California have a Basic Speed Rule, which requires one to never drive at a speed greater than is safe for conditions. Prima facie is a Latin phrase essentially meaning a fact presumed to be true unless it is disproved.

There are three options for how to plead when you get a traffic ticket. You can plead Guilty, Not Guilty, or No Contest.

What is meant by pleading Guilty? Essentially you are admitting to the charges and accepting the punishment (generally just a fine for the traffic ticket and points going on your record).

What is meant by pleading Not Guilty? Opposite of Guilty, you are not admitting to the charges. After a Not Guilty Plea has been entered, the case will be set for trial. Your trial options can include an in person trial with a judge and officer present or a trial in writing where you submit a declaration signed under penalty of perjury to the judge.

What is meant by pleading No Contest? Equipment violations (such as illegal tinted windows, missing license plates, worn out tires, or a broken tail light) are generally marked as ‘correctable’ on your ticket, meaning if you fix it you are eligible to have it dismissed.

Although most equipment violation tickets do not result in a point going on your record, they are recorded on your driver record, and the cost of the ticket will be far less if you have the violation corrected. Be Aware in Business Districts:

If you are in a business district, even in the absence of a turn prohibition sign, you cannot make a U-turn unless it is at an opening specifically provided for turns or at an intersection.

Residential Areas More Lenient:

When driving through a residential area, U-Turn rules are more relaxed. In the absence of a ‘No U-Turn’, you can generally make a U-Turn as long as you have an unobstructed view of at least 200 feet ahead and behind (both directions). U-Turns are even permitted across double yellow lines (although you cannot pass over double yellow line it is ok to make a U-Turn).

 Everybody makes mistakes, even officers. If you received a ticket and feel you are innocent, you should gather proof as soon as you can.

For example, if the officer ticketed you for ignoring a stop sign, but there was no visible stop sign at the time because it was knocked down by the wind or a tree, take a picture right away. You’ll want to make color copies to provide to the court as proof as well as keep a copy for yourself.

As another example, if the officer ticketed you for failing to yield to a pedestrian but there was no pedestrian anywhere near your vehicle, check for witnesses and ask them for a statement about what they saw. If you agree with their version of what happened, write down their name and phone number and ask if they would be willing to testify in your favor at court.

When you apply for a driver’s license in another state, the system alerts the inquiring state (referred to as the State – of – inquiry) as to whether there is any action against your driver’s license in other states. It is then up to the state where you have applied for a license to issue you a license. States have varying rules and some may not issue a license until the action is cleared.

Your actual driving record (listing points and violations and accidents) is not maintained in the PDPS. The purpose of the PDPS is to provide information such as your name, driver’s license number, date of birth, and the state that added you (this state is referred to as State – of –record). More than 5 million traffic violations are filed each year in California’s courts (reported by the Superior Court of California, County of Glenn).

Traffic violations are broken down into three categories based on the level of seriousness. The infraction level, the misdemeanor level, and the felony level. Most traffic violations are infractions, but some, like vehicular manslaughter (i.e. a pedestrian dies because you ran over them with your car), are felonies.

Infractions are not punishable by jail or prison and are not subject to trial by jury therefore the punishment is generally just a fine. Penalties for infractions can be as much as $200.00 or more for common traffic infractions including unsafe speed, failing to obey a sign, and making an unsafe lane change.

Misdemeanors, such as driving while intoxicated by alcohol or drugs, can carry penalties of as much as $2,000 or more and/or jail time. The maximum penalty allowed in California for a misdemeanor is one year in county jail and/or a fine. Many drivers are unaware that if they stop past the limit line they are technically just as guilty as if they had failed to stop at all. There is a natural tendency to roll past the limit line before stopping especially when making a right hand turn or in order to “creep” forward to a point of visibility. However just because everyone does it doesn’t make it legal.

The court addressed this very issue in a San Bernardino Superior court case where the Defendant, Binkowski, made a complete stop, but stopped with her front wheels over the limit line.

The court scrutinized the language of the stop sign law in the vehicle code (must stop at limit line, or before entering crosswalk, or if none before entering intersection), defined limit line (the point at which traffic is required to stop), and went a step further and defined what was meant by point (specified position). The court found the intent of the law is to require a full stop be made before any part of the vehicle crosses the limit line (this includes the front bumper).

California courts have been feeling the pressure of the budget crisis over the past few years. Furloughs, layoffs, and courthouse closures, have resulted in significant delays in the time it takes you to get your traffic ticket resolved, as well as long waits in line at courthouses and difficulty getting through to a live clerk on the phone.

The Los Angeles Superior court stated in its 2011 Annual Report that its now takes about nine months from the time a person receives a traffic ticket until the time they can get a court date.

You may be wondering how this affects your right to speedy trial.

Under California Law (Penal code 1382 section 3), the court shall dismiss an action (unless good cause is shown) when a person in an infraction case (most traffic tickets are infractions) is not brought to trial within 45 days after they have been arraigned or entered a plea (whichever happens later). So if you go to court, plead not guilty, and request a court trial, the 45-day time period starts to run from that point. If the court gives you a trial date and it is past that 45 day period make sure you do not give up your right to a speedy trial by signing a waiver of the 45 day trial requirement (which the court may try to have you do). If you do not waive time you should be eligible to have the ticket dismissed by the judge when you do appear for your court trial.

The California Court of appeal decided in People v. Carmona that a turn signal is not needed when there is nobody around. The opinion was written by Justice O’Leary.

Carmona made a right hand turn without a signal and the only other vehicle around was the officer who was driving in the opposite direction 50+ feet away. Carmona made the turn away from the officer’s vehicle so there was no chance his vehicle could have been affected by Carmona’s turn and therefore there was no violation of the Vehicle Code section 22107 (requires signal when turning anytime another vehicle might be affected by the movement).

Not all of us can get out of a ticket using the old “I’m famous” line, like Oakland Raiders rookie player recently tweeted after dodging a ticket by telling the officer he was a Raider. Some of are stuck fighting tickets the old fashioned way. Here at TicketHitMan.com we prefer to use the old Trial by Written Declaration method that’s been around since late 1970 (though surprisingly not many people know about it). Here’s a recent success story for you.

A client came to us with a speeding ticket, cited for 20 mph above the legal limit. The Client honestly felt like most of the time she was going with the flow of traffic, she had cars on both sides of her, and she hadn’t had a ticket in ten years so she was a relatively safe driver.

Using the client’s facts, and doing some research of our own, we were able to prepare a well written statement for her to use in getting out of this ticket. Raised issues included discussing the officer’s failure to obtain a clear line of sight to the client’s vehicle to accurately gauge her speed in the dark with other cars around her car and in between them, lack of proof as the accuracy of the officer’s radar gun. We also felt important to point out to the court that the client had a clean driving record for numerous years and that this ticket was clearly not a true representation of her actual driving habits.

Two months later the client received a not guilty verdict from the court. The ticket has been dismissed from her record and she received over $300 back from the court (refunding her bail that she had been required to post up front). The State of California requires every driver and every owner of a motor vehicle to be in possession of proof of financial responsibility (insurance) at all times.

So what happens if you couldn’t find your insurance card at the time the officer stopped you or if there was a lapse in your insurance coverage and you didn’t get insurance until after you were ticketed?

Many courts offer remedies for these types of situations and you can usually avoid making a personal appearance in court so long as you have proof of insurance covering the date you got the ticket. If you do, you can mail in a copy of your insurance card along with the fee (generally $25.00) to the court.

Other acceptable proofs of insurance may include:

  • The name of the insurance company or surety company and the number of the insurance policy or surety bond
  • The certificate or deposit number issued by the DMV (if the owner of the vehicle is self – insured)
  • An insurance covering note (Covering notes may be issued to bind insurance temporarily for a period of about 90 days, pending the issuance of the policy)
  • Proof the vehicle is owned or leased by the government

If you did not have any insurance at the time you were stopped you will most likely have to make a personal appearance in court and you must bring proof that you now have insurance. The court may still offer you a reduced fine since you have proof of current insurance.  Late last year the National Transportation Safety Board recommended a nationwide ban on the use of cell phones while driving.

Earlier this year, a new Federal law, enacted by the Federal Motor Carrier Safety Administration, sought to cut down on the number of distracted driver related crashes by banning commercial vehicle drivers from using cell phones while driving.

Just recently, the city of Chapel Hill in North Carolina has gone a step above California’s hands free law which just requires a hands free device to be used when driving, and has elected to ban cell phone use while driving entirely (regardless of whether a hands free device is used).

The law says you cannot drive a car while using a cell phone (without a hands free device) and many perceive this to only apply while the car is “in motion”. Just last year the California Court of Appeal in San Francisco decided a case involving a motorist who was ticketed for making a phone call while stopped at a red light.

The motorist argued  that while he was stopped at a red light his car was not in motion, and since his car was not in motion, he was not actually driving it and therefore it was permissible for him to use his phone until he resumed movement.

The court made clear however that fleeting pauses while driving including those made in stop and go traffic, at stop light and stop signs, and while waiting for pedestrians, is considered “driving” for purposes of being cited under the law. Conducting Discovery and subpoenaing documents from the police department where the officer who issued your ticket is employed for items relating to your traffic infraction case (example: the officer’s notes or calibration records for the officer’s radar) can be a time consuming process and it’s also rarely done at the infraction level. Because discovery requests are rarely done at the infraction level it might even give the citing officer a heads up that you are going to fight the ticket and hurt your chances at getting it dismissed.

 If you want to get your hands on something like a traffic survey for the street you were cited on to see if the speed limit is justified, a better option is to make a simple public records request to the public works department in the city of where you were cited or the City Hall. The future state of Red Light Cameras in California is questionable as more and more judges rule that the evidence gathered by red light camera is in admissible in court.

The California Court of Appeal in People v. Borzakian (2012) Second District Court of Appeal, Div. 7, B229748, reversed a decision to rule in favor of a motorist accused of failing to stop for a red light at the intersection of Beverley Drive and Wilshire Boulevard in the City of Beverly Hills in June of 2009. The camera generated photographs were taken by equipment maintained by a private camera company (Red Flex) and yet no employee from the camera company was present in court, rather the case was presented by a Beverly Hills Police Officer.

The court ruled the Officer’s testimony failed to establish the photographs were trustworthy and that without proper testimony the photographs were not properly admitted, and without the photographs being admitted there lacked evidence to support the motorist had run the red light.

This is in keeping with an Orange County Superior Court Appellate Division case, People v. Khaled (2010) 186 Cal. Most traffic violations will remain on your California Department of Motor Vehicles driving record for a period of several years.

 There is something called “expungement” that allows certain convictions to be removed from your record, and although infractions are now eligible to be expunged (request for court to dismiss or remove from record), it is important to know this is only true for NON traffic infractions. Traffic infractions such as speeding, red light, stop sign convictions, cannot be removed from your record through expungement.

For traffic violations that are assessed one point by the DMV (i.e.. unsafe lane change, crossing double yellow lines), they remain on your record for three years, counting from the date of the violation. A traffic ticket will generally be entered into a court’s computer system within a couple weeks after you receive it. Once your ticket is entered into the court’s system your ticket fine and/or bail amount is calculated using the court’s bail amount schedule and your Driver License Record to calculate the total due.

Bail amounts for traffic infraction violations of the California Vehicle Code are established by the Judicial Council of California. The “Uniform a Bail and Penalty” schedule is established in order to achieve a statewide standard of uniformity for setting bail/fine amounts.

Sometime around 1969, California created a new way to classify traffic tickets – the infraction.

An infraction is not punishable by imprisonment which is why you just get slapped with a fine when you get a traffic ticket instead of going to jail. Per California Penal code, “A person charged with an infraction shall not be entitled to a trial by jury.” (CA Penal Code 19.6)

A Statewide traffic safety survey conducted by the CA Office of Traffic Safety showed that speeding drivers may be the cause of 17.6 % of the safety problems on CA highways (coming in third after texting and talking on the phone). The officer had you sign that ticket for a reason, that signature represents your agreement to take care of the ticket by the date listed there below your signature. But many people ignore this date and instead wait for a separate notice to be mailed to them directly by the courthouse listed on the ticket because the officer told them to wait for this or told them they would be receiving something in the mail.

The real truth of the matter?  The notice often sent by courts, called a “courtesy letter” or “courtesy notice”, is not mandatory. There is a misconception that the court is required to send you this courtesy notice. You must take care of the ticket by the due date whether or not you receive any notice from the court.  In fact if you flip it over and read the back of your ticket there is likely a caveat printed there stating: “A courtesy notice MAY be mailed to you…. if you do not receive such courtesy notice, you are still required to comply…” (emphasis added).

Ever been tempted to spray one of those products on your license plate (that's supposed to reflect the flash of a camera) to avoid getting caught by a red light camera ... Think again!

That's right it's actually illegal to do this in California. Although the vehicle code section 5201 does not specifically call out "license plate blocker spray" it does say that you cannot put ANY product that obstructs or impairs the reading (or recognition) of a license plate by an electronic device operated by law enforcement. License plate blocker spray certainly seems to fit the bill being it is a product that impairs the ability of say a red light camera, from being able to get a clear and recognizable image of your plate number.

As many should know, currently under California Traffic law a child is only required to be in a booster seat until the age of 6 (or 60 pounds whichever comes first). What many may not know is that Governor Brown has signed a new stricter law to increase the minimum requirements.

The new law is to go in effect on January 1 and will require parents to transport   their children with a booster seat until that child is 8 years old (or at least 4 foot 9, whichever comes first).

The Statewide Safety Campaign which utilized electronic highway signs to display a message reminding drivers of the safety law requiring drivers to move over or slow down for highway workers may have ended but drivers should still be watchful for highway workers and move over if you see them to avoid getting a ticket.

CA Senate Bill 29 (which passed the Senate early last month) seeks to make changes to the existing law for red light cameras. One of the changes relates to the number of warning signs that must posted at each camera enforced intersection.

Under current law, warning signs must be posted and visible to traffic approaching from all directions, or at all the main entrances to town including, at a minimum, freeways, bridges, and state highway routes (VC§ 21455.5(a) (1) ).

The new bill if passed into law would no longer require warning signs to be visible from traffic approaching from ALL directions and instead will only require the signs to be visible to traffic which could be affected or subject to the camera enforcement system. Opposers of this Bill see that this would allow for a reduction of warning signs and therefore would result in less notice to drivers.

Current law does not have any requirement as to how close to an intersection warning signs must be posted and in fact allows for signs to be posted at locations other then the intersection itself (ex: entrances to town) which often results in a lack of notice to drivers who would expect to see a warning sign right at the intersection or very near to. The new Bill if passed into law would require warning signs to be posted within 200 feet of a camera enforced intersection, a change welcomed by Supporters of this Bill.
